Terms of Service

These Terms govern your use of Fractional Engineer, operated by Lino Agency LLC (“we,” “us”), during early-access validation. By completing onboarding or reserving founding access, you agree to these Terms.

Early-access nature

Fractional Engineer is in active validation. Features described on this site are forward-looking, and the assistant does not yet connect to your tools, repositories, or codebases. We may change or discontinue the service during this period.

Messaging

Fractional Engineer operates through text messages. By verifying your phone number you agree to receive account and service messages from us at that number — for example your verification code, a welcome message, and waitlist or account updates — and, where you enable it, your conversation with the assistant. Messages are delivered by third-party messaging providers over SMS and, where available, iMessage.

Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help; you can also reach us at hello@fractional.engineer. Consent to receive marketing messages is optional and is not a condition of using the service. Carriers are not liable for delayed or undelivered messages. Founding access

• Founding access locks in a rate of $99 per year for life — it does not revert to the regular $360 per year ($30 per month). It includes unlimited use of the assistant at our highest service tier.
• You pay a one-time, refundable $99 now to reserve your spot and cover your first year. When we activate your assistant, founding access continues as a $99/year subscription at that locked-in rate; because your first year is already paid, the next charge is twelve months later. You can cancel before activation for a full refund.
• It is fully refundable until activation — the point at which we enable the live assistant for your account. Until then you may request a full refund for any reason, and if we do not launch the service your payment is refunded in full.
• To request a refund, email hello@fractional.engineer from the address on file. We refund to your original payment method, normally within 10 business days.
• During early access, founding access also aims to include: new assistant capabilities and tool connections before general availability; hands-on help from our team when the assistant cannot yet complete a request; and a one-to-one setup call. These benefits are part of the forward-looking early-access experience and may change as the product evolves.

Acceptable use

Do not abuse verification or messaging, attempt to disrupt the service, or use it unlawfully. We may suspend access for abuse or to protect the service and other users.

Disclaimer and limitation of liability

The service is provided “as is” and “as available” during validation, without warranties of any kind. To the maximum extent permitted by law, our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the prior twelve months or US $50, and we are not liable for indirect, incidental, or consequential damages.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute not otherwise resolved, and you submit to the venue of those courts.

Changes to these Terms

We may update these Terms as the product evolves. Material changes will be reflected by the “last updated” date above, and continued use after an update means you accept the revised Terms.
